Contents of Exceptions to an Arbitration Award

As set forth in the Authority's Regulations at 5 C.F.R. Part 2425, exceptions must contain at a minimum the following listed items:

  • Statement of the grounds on which review is requested (5 C.F.R. 2425.2(a))
  • Evidence or rulings bearing on the issues before the Authority (5 C.F.R. 2425.2(b))
  • Arguments in support of stated grounds (5 C.F.R. 2425.2(c))
  • Specific reference to the pertinent documents & citations of authorities (5 C.F.R. 2425.2(c))
  • Legible copy of the arbitrator's award (5 C.F.R. 2425.2(d))
  • Legible copies of other pertinent documents (5 C.F.R. 2425.2(d))
  • Name and address of the arbitrator (5 C.F.R. 2425.2(e))

As set forth in the Authority's Regulations at 5 C.F.R. Part 2425 and 5 C.F.R. Part 2429, a complete copy including all attachments of the exceptions must:

  • Be served by certified mail or personal delivery on all counsel of record at the arbitration hearing, and on other designated representatives. (5 C.F.R. 2425.1(d) & 2429.27(b))
  • Contain a signed and dated statement of service with names and addresses of parties served, date of service, nature of document served, and whether by certified mail or personal delivery. (5 C.F.R 2429.27(c))
  • Contain an original and 4 complete and legible copies of all documents .(5 C.F.R. 2429.25)
  • Be addressed to the Office of Case Intake and Publication.
